Article R743-139-17 of the French Commercial code

Any dismissal, envisaged by the holder of the office, of an employed commercial court clerk is subject to the opinion of a national commission composed as follows:

1° A magistrate, chairman;

2° Two office-holding or associate clerks, appointed on a proposal from the Conseil national des greffiers des tribunaux de commerce;

3° Two salaried clerks, appointed on a proposal from the most representative trade union organisations of salaried commercial court clerks or, failing that, from the Conseil national des greffiers des tribunaux de commerce;

The members of the commission are appointed for four years by order of the Minister of Justice.

Each member has a deputy appointed under the same conditions.

Tout licenciement, envisagé par le titulaire de l’office, d’un greffier de tribunal de commerce salarié est soumis à l’avis d’une commission nationale composée comme suit :

1° Un magistrat, président ;

2° Deux greffiers titulaires d’office ou associés, désignés sur proposition du Conseil national des greffiers des tribunaux de commerce ;

3° Deux greffiers salariés, désignés sur proposition des organisations syndicales les plus représentatives des greffiers des tribunaux de commerce salariés ou, à défaut, du Conseil national des greffiers des tribunaux de commerce ;

Les membres de la commission sont nommés pour quatre ans par arrêté du garde des sceaux, ministre de la justice.

Chacun d’eux a un suppléant nommé dans les mêmes conditions.
