Article R743-22 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the foreign national is held at the disposal of the courts, the public prosecutor decides on the conditions of the holding. He shall inform the foreign national and the administrative authority that ordered the detention without delay.

Lorsque l’étranger est maintenu à la disposition de la justice, le procureur de la République décide des conditions du maintien. Il en informe sans délai l’étranger et l’autorité administrative qui a prononcé le placement en rétention.
