Article R744-10 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The holding facilities referred to in article R. 744-8 are created, on a permanent basis or for a fixed period, by prefectoral order specifying whether the facility is likely to accommodate families.
A copy of this order is sent without delay to the public prosecutor and to the Contrôleur général des lieux de privation de liberté.

Article R744-10

Les locaux de rétention mentionnés à l’article R. 744-8 sont créés, à titre permanent ou pour une durée déterminée, par arrêté préfectoral précisant si le local est susceptible d’accueillir des familles.
Une copie de cet arrêté est transmise sans délai au procureur de la République et au Contrôleur général des lieux de privation de liberté.
