Subsection 2: Administrative detention facilities

When, due to particular circumstances, in particular time or place, foreign nationals detained pursuant to this Title cannot be placed immediately in an administrative detention centre, the Prefect may place them in premises adapted for this purpose, known as “administrative detention premises” governed by this sub-section. .

The holding facilities referred to in article R. 744-8 are created, on a permanent basis or for a fixed period, by prefectoral order specifying whether the facility is likely to accommodate families.A copy of this order is sent without delay to the public prosecutor and to the Contrôleur général des lieux de privation de liberté.
