Article R751-1 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Without prejudice to the second paragraph of article 11-1 of decree no. 2004-374 of 29 April 2004, the authority competent to place an asylum seeker under house arrest pursuant to article L. 751-2 is the departmental prefect and, in Paris, the police prefect.
The same authority is competent to have the foreign national placed under house arrest taken to ensure that he or she appears when summoned by the administrative authority and for the interviews scheduled as part of the procedure for determining the State responsible for the asylum application, and to refer the matter to the liberty and detention judge for the purpose of requesting the police services or gendarmerie units pursuant to article L. 751-5.

Sans préjudice du second alinéa de l’article 11-1 du décret n° 2004-374 du 29 avril 2004, l’autorité compétente pour assigner à résidence un demandeur d’asile en application de l’article L. 751-2 est le préfet de département et, à Paris, le préfet de police.
La même autorité est compétente pour faire conduire l’étranger assigné à résidence en vue d’assurer sa présentation aux convocations de l’autorité administrative et aux entretiens prévus dans le cadre de la procédure de détermination de l’Etat responsable de la demande d’asile et pour saisir le juge des libertés et de la détention aux fins de requérir les services de police ou les unités de gendarmerie en application de l’article L. 751-5.
