Subsection 1: While the State responsible for examining the asylum application is being determined and for the purposes of enforcing the transfer decision

Without prejudice to the second paragraph of article 11-1 of decree no. 2004-374 of 29 April 2004, the authority competent to place an asylum seeker under house arrest pursuant to article L. 751-2 is the departmental prefect and, in Paris, the police prefect.The same authority is competent to have the foreign national placed under house arrest taken to ensure that he or she appears when summoned by the administrative authority…

A foreign national placed under house arrest pursuant to article L. 751-2 may be required to reside in the accommodation provided for in 2° of article L. 552-1.

For the application of the third paragraph of article L. 751-5, the procedure shall be as set out in articles R. 733-6 to R. 733-13.

The provisions of articles R. 732-5, R. 733-1, R. 733-3 and R. 733-5 to R. 733-13 are applicable to foreign nationals assigned to residence pursuant to article L. 751-2.
