Article R754-12 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When the French Office for the Protection of Refugees and Stateless Persons decides, pursuant to Article L. 754-7, not to rule under the accelerated procedure, it shall send its decision to the authority holding the asylum applications in the place of detention, as well as to the Prefect who ordered the person to remain in detention.
The Prefect shall immediately end the detention and communicate his decision to the authority holding the asylum applications in the place of detention. The Prefect will also inform the Director General of the Office.

Article R754-12

Lorsque l’Office français de protection des réfugiés et apatrides décide, en application de l’article L. 754-7, de ne pas statuer en procédure accélérée, il transmet sa décision à l’autorité dépositaire des demandes d’asile dans le lieu de rétention, ainsi qu’au préfet qui a ordonné le maintien en rétention.
Le préfet met fin immédiatement à la rétention et communique sa décision à l’autorité dépositaire des demandes d’asile dans le lieu de rétention. Il en informe également le directeur général de l’office.
