As soon as the application is received, the prefect will send a copy of the first part of the application, as defined in article R. 761-12-1, to the manager of the market of national interest, with a view to finding out whether it has the areas required to carry out the project. The Marché d’Intérêt National manager has six weeks in which to respond, failing which it is deemed not to have the necessary surface area.
If the manager of the market of national interest has indicated that he does not have the necessary surface areas to allow the proposed establishment or extension or has not replied within the six-week period, the prefect will inform the applicant that he has authorisation as of right to carry out his project.
If the manager of the Marché d’Intérêt National has the necessary surface area to allow the planned site to be set up or extended, he will send the Prefect, who will send it to the applicant without delay, a proposal for installation within the market enclosure, including the market’s internal regulations, a plan showing the location of the sales areas, the characteristics of the land or real estate facilities likely to be made available to the applicant, the financial conditions for this provision, as well as the conditions for the provision of fluids and the treatment of waste and wastewater. If the applicant refuses this proposal or fails to respond within a period of fifteen days, the Prefect will continue the examination of the authorisation application.
