The file initially sent by the applicant may include only the first part of the application as defined in Article R. 761-12-1. In this case, the provisions of Article R. 761-12-2 only apply to the first part of the application and the prefect, when sending the installation proposal presented by the market manager to the applicant, shall inform the applicant that, if he refuses this proposal, he must send the second part of the application file within one month.

In the absence of a response from the applicant within this period or, if the prefect has indicated to the applicant, by registered letter with acknowledgement of receipt, that the second part of the application transmitted is incomplete, in the absence of transmission of the additional documents within fifteen days of the acknowledgement of receipt, the procedure is closed and the file is returned to the applicant.

Le dossier initialement transmis par le demandeur peut ne comprendre que la première partie de la demande telle que définie à l’article R. 761-12-1. En ce cas, les dispositions de l’article R. 761-12-2 ne s’appliquent qu’à la première partie de la demande et le préfet, lorsqu’il adresse la proposition d’installation présentée par le gestionnaire du marché au demandeur, signale à celui-ci qu’il doit, s’il refuse cette proposition, transmettre la seconde partie du dossier de demande dans un délai d’un mois.

En l’absence de réponse du demandeur dans ce délai ou, si le préfet a indiqué au demandeur, par lettre recommandée avec demande d’avis de réception, que la seconde partie de la demande transmise est incomplète, en l’absence de transmission des pièces complémentaires dans les quinze jours de l’avis de réception, la procédure est close et le dossier est renvoyé au demandeur.
