Users may be subject to disciplinary sanctions for breaching the rules governing the market. The interested party must be given the opportunity to present their observations, under the conditions set out in articles L. 121-1, L. 121-2 and L. 122-1 of the code des relations entre le public et l’administration.
These penalties are:
<1° A warning;
2° A warning including a pecuniary penalty of an amount equal to the fine for a third-class contravention ;
3° A reprimand involving a pecuniary sanction of an amount equal to the fine for a fourth-class contravention;
4° Suspension for a period that may not exceed three months;
5° Exclusion including, where appropriate, withdrawal of the occupancy contract.
Warnings and reprimands are issued by the manager.
Suspension and exclusion are pronounced by the prefect responsible for policing the market, following the opinion of the disciplinary board.
