Authorisation to set up on the market of national interest is given by its manager. It is preceded by appropriate publicity.
It may be:
1° Either an authorisation to occupy exclusively a developed site or a plot of land;
2° Or an authorisation to occupy non-exclusively a site in a developed facility: square, hall, covered area or quay allocated for the common use of certain categories or all vendors, in accordance with the special conditions defined by the internal regulations.
The occupancy authorisation imposes on the beneficiary the obligation to operate under his personal responsibility.
The occupancy authorisation decision is notified to the interested party by the manager. It sets out the nature and characteristics of the authorised facilities and the activities that the holder undertakes to carry out there, the date on which it comes into force and its duration, which may not exceed the date on which the land is made available by the public owner.
