Article R81 of the French Code of Criminal Procedure

If there are one or more criminal records other than those listed in articles 775 and 775-1 A, the content as well as that of the information provided for in Article 769 is reproduced on bulletin no. 2.

If not, the bulletin n° 2 is marked “nil”.

If the request for bulletin no. 2 comes from the central authority of a Member State of the European Union, the reply is sent without delay and at the latest within ten working days of receipt of the request or, in the event of a request for additional information sent to the requesting State for the identification of the person concerned, of the reply sent by that State.

The transmissions provided for in this Article may be made by secure electronic means.

S’il existe une ou plusieurs fiches du casier judiciaire autres que celles figurant aux articles 775 et 775-1 A, la teneur ainsi que celles des mentions prévues à l’article 769 en est reproduite sur le bulletin n° 2.

Sinon, le bulletin n° 2 est revêtu de la mention ” néant “.

Si la demande du bulletin n° 2 émane de l’autorité centrale d’un Etat membre de l’Union européenne, la réponse est transmise sans délai et au plus tard dans les dix jours ouvrables à compter de la réception de la demande ou, en cas de demande d’informations complémentaires adressée à l’Etat requérant pour l’identification de la personne concernée, de la réponse transmise par cet Etat.


Les transmissions prévues au présent article peuvent être effectuées par voie électronique sécurisée.
