Article R811-49 of the French Commercial code

The Secretary of the Commission shall notify the decision to the person concerned, the President of the National Council, the Guarantee Fund, the Government Commissioner and the Public Prosecutor when he has initiated disciplinary proceedings, by registered letter with acknowledgement of receipt. It shall also notify this decision to the Minister of Justice, in administrative form.

The notification shall indicate the time limit and procedures for appealing against the decision.

The decision shall also be brought to the attention of the public prosecutor at the court of appeal within whose jurisdiction the court-appointed administrator has his professional domicile and, where applicable, a branch office.

If the disciplinary action follows a complaint, the author of the complaint is informed by the Government Commissioner.

Le secrétaire de la commission notifie par lettre recommandée, avec demande d’avis de réception, la décision à l’intéressé, au président du Conseil national, à la Caisse de garantie, au commissaire du Gouvernement et au procureur général lorsqu’il a engagé l’action disciplinaire. Il notifie également cette décision au garde des sceaux, ministre de la justice, en la forme administrative.

La notification indique le délai et les modalités du recours ouvert à l’encontre de la décision.

La décision est également portée à la connaissance du procureur général près la cour d’appel dans le ressort de laquelle l’administrateur judiciaire a son domicile professionnel et, le cas échéant, un bureau annexe.

Si l’action disciplinaire est consécutive à une plainte, l’auteur de celle-ci est informé par le commissaire du Gouvernement.
