Article R811-62 of the French Commercial code

The employment contract shall be drawn up in writing, subject to the suspensive condition of the employee’s registration on the list mentioned in Article L. 811-2 as a court-appointed administrator and his swearing in. The condition is deemed to have been fulfilled on the date of swearing in.

It may not contain any clause likely to limit the employee’s freedom of establishment at a later date or to affect his independence. It specifies the conditions of his remuneration.

A copy of the employment contract is sent, as soon as it is signed, to the president of the Conseil national des administrateurs judiciaires et des mandataires judiciaires; the same applies to any amendment to the contract.

Le contrat de travail est établi par écrit, sous la condition suspensive de l’inscription sur la liste mentionnée à l’article L. 811-2 du salarié en qualité d’administrateur judiciaire et de sa prestation de serment. La condition est réputée acquise à la date de la prestation de serment.

Il ne peut comporter aucune clause susceptible de limiter la liberté d’établissement ultérieur du salarié ou de porter atteinte à son indépendance. Il précise les conditions de sa rémunération.

Une copie du contrat de travail est adressée, dès sa signature, au président du Conseil national des administrateurs judiciaires et des mandataires judiciaires ; il en est de même pour toute modification à ce contrat.
