Article R8114-5 of the French Labour Code

Two copies of the proposed settlement are sent to the offender by any means that can be used to establish a date certain, within four months for minor offences and one year for major offences, from the date on which the official report establishing the offence was closed.

If the offender accepts it, he or she must return a signed copy within one month of receiving it. If the offender has not returned a signed copy within the aforementioned period, the proposed settlement is deemed to have been rejected.

La proposition de transaction est adressée en double exemplaire à l’auteur de l’infraction par tout moyen permettant d’établir date certaine, dans le délai de quatre mois pour les contraventions et d’un an pour les délits, à compter de la date de clôture du procès-verbal de constatation de l’infraction.

S’il l’accepte, l’auteur de l’infraction en retourne un exemplaire signé dans le délai d’un mois à compter de sa réception. Si l’auteur de l’infraction n’a pas renvoyé un exemplaire signé dans le délai susmentionné, la proposition de transaction est réputée refusée.
