The accounting officer shall suspend the payment of expenditure where he finds, in the course of his checks, irregularities or inaccuracies in the certifications issued by the chairman of the High Council. He shall inform the Chairman of the High Council accordingly.

Where the accounting officer has suspended payment of expenditure, the chairman of the High Council may, in writing and under his responsibility, require the accounting officer to pay. The accounting officer shall comply with the requisition and report to the minister responsible for the budget, who shall forward the requisition order to the Court of Auditors.

By way of derogation from the provisions of the second paragraph, the accounting officer must refuse to comply with the requisition order when the suspension of payment is motivated by:

1° The absence of justification for the service rendered;

2° The non-discharging nature of the payment;

3° The lack of available funds.

In cases where the requisition is refused, the accounting officer shall immediately report to the minister responsible for the budget.

L’agent comptable suspend le paiement des dépenses lorsqu’il constate, à l’occasion de l’exercice de ses contrôles, des irrégularités ou que les certifications délivrées par le président du Haut conseil sont inexactes. Il en informe le président du Haut conseil.

Lorsque l’agent comptable a suspendu le paiement des dépenses, le président du Haut conseil peut, par écrit et sous sa responsabilité, requérir l’agent comptable de payer. L’agent comptable défère à la réquisition et rend compte au ministre chargé du budget, qui transmet l’ordre de réquisition à la Cour des comptes.

Par dérogation aux dispositions du deuxième alinéa, l’agent comptable doit refuser de déférer à l’ordre de réquisition lorsque la suspension du paiement est motivée par :

1° L’absence de justification du service fait ;

2° Le caractère non libératoire du règlement ;

3° Le manque de fonds disponibles.

Dans les cas de refus de la réquisition, l’agent comptable rend immédiatement compte au ministre chargé du budget.
