Article R821-5 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The official report noting the transport company’s failure, referred to in article L. 821-12, is signed:
1° By the head of the national police department responsible for border control or territorially competent, or a civil servant designated by him, holding at least the rank of brigadier;
2° By the head of the customs department responsible for border control or a civil servant designated by him, holding at least the rank of second-class senior inspection officer;
3° Or by the commander of the territorially competent gendarmerie unit or a military officer designated by him, holding at least the rank of gendarme.

Article R821-5

Le procès-verbal constatant le manquement de l’entreprise de transport, mentionné à l’article L. 821-12, est signé :
1° Par le chef du service de la police nationale chargé du contrôle aux frontières ou territorialement compétent, ou un fonctionnaire désigné par lui, titulaire au moins du grade de brigadier ;
2° Par le chef du service des douanes chargé du contrôle aux frontières ou un fonctionnaire désigné par lui, titulaire au moins du grade d’agent de constatation principal de deuxième classe ;
3° Ou par le commandant de l’unité de gendarmerie territorialement compétente ou un militaire désigné par lui, titulaire au moins du grade de gendarme.
