Article R822-11 of the French Commercial code

The High Council checks that the candidate meets the conditions required for registration. The High Council or its delegate collects all relevant information on the candidate and requests the bulletin no. 2 of the criminal record.

It may summon the candidate to attend a hearing.

Where, at the date of application for registration, the candidate is in one of the cases of incompatibility provided for in article L. 822-10, registration may be decided subject to the suspensive condition that the situation is regularised within six months. The interested party must provide the Haut Conseil with proof that the incompatibility has been lifted.

Article R822-11

Le Haut conseil vérifie si le candidat remplit les conditions requises pour être inscrit. Le Haut conseil ou son délégataire recueille sur le candidat tous renseignements utiles et demande le bulletin n° 2 du casier judiciaire.

Il peut convoquer le candidat afin de procéder à son audition.

Lorsque, à la date de sa demande d’inscription le candidat se trouve dans l’un des cas d’incompatibilité prévus à l’article L. 822-10, son inscription peut être décidée sous condition suspensive de régularisation de sa situation dans un délai de six mois. L’intéressé justifie auprès du Haut conseil de la fin de cette incompatibilité.
