Article R822-23 of the French Commercial code

Statutory auditors who have not carried out an audit certification engagement for three consecutive years and who have not complied during that period with the obligation provided for in I of Article L. 822-4 declare to the regional compagnie des commissaires aux comptes to which they belong, prior to accepting a new audit engagement, the conditions under which they have satisfied the specific continuing education obligation referred to in Article L. 822-4.

They shall keep evidence of compliance with this obligation for six years from the date of acceptance of the new statutory audit engagement.

The regional companies of statutory auditors shall report annually to the Compagnie nationale on compliance by the statutory auditors within their jurisdiction with their reporting obligation.

Les commissaires aux comptes qui n’ont pas exercé de mission de certification des comptes pendant trois années consécutives et qui n’ont pas respecté durant cette période l’obligation prévue au I de l’article L. 822-4 déclarent à la compagnie régionale des commissaires aux comptes dont ils relèvent, préalablement à l’acceptation d’une nouvelle mission de certification des comptes, les conditions dans lesquelles ils ont satisfait à l’obligation de formation continue particulière mentionnée à l’article L. 822-4.

Ils conservent pendant six ans à compter de l’acceptation de la nouvelle mission de certification des comptes les justificatifs relatifs au respect de cette obligation.

Les compagnies régionales des commissaires aux comptes rendent annuellement compte à la Compagnie nationale du respect par les commissaires aux comptes de leur ressort de leur obligation déclarative.
