The following may be entered on the list of statutory auditors referred to in I of Article L. 822-1, pursuant to the provisions of the second paragraph of article L. 822-1-2, persons already approved by the competent authorities of another Member State of the European Union to carry out statutory audits, subject to having passed an aptitude test demonstrating adequate knowledge of the laws, regulations, standards and professional rules required to carry out statutory audits in France.
The terms and conditions of this test are set by order of the Minister of Justice.
Applicants are admitted to take the aptitude test by decision of the Minister of Justice.
To this end, the interested party sends his or her file to the Minister of Justice. On receipt of the complete file, a receipt will be issued.
The decision of the Minister of Justice specifies the subjects on which the candidate is to be tested in the light of his or her initial training. Reasons must be given for the decision and it must be made within four months of the date of issue of the receipt. Failure to reply within this time limit shall constitute acceptance of the application for registration for the aptitude test.
The provisions of this article also apply to persons who, although not approved in another Member State of the European Union, meet the conditions in terms of qualifications, diplomas and practical training for obtaining such approval in accordance with the provisions of Directive 2006/43/EC of the European Parliament and of the Council of 17 May 2006 on statutory audits of annual accounts and consolidated accounts.
