Article R824-16 of the French Commercial code

The person being prosecuted is summoned to appear before the panel no less than one month before the date of the meeting.

The president of the regional compagnie des commissaires aux comptes to which the person being prosecuted reports is notified of the meeting and of his right to ask to be heard.

The summons mentions the composition of the panel. It shall inform the person being prosecuted of the right to be heard, in person or represented by counsel. It states that written observations must reach the panel and the general rapporteur no later than eight clear days before the hearing.

When the case is referred to a subsequent hearing, the minimum notice period may be reduced to seven days.

La personne poursuivie est convoquée devant la formation restreinte dans un délai qui ne peut être inférieur à un mois avant la date de la séance.

Le président de la compagnie régionale des commissaires aux comptes dont relève la personne poursuivie est avisé de la séance et de sa faculté de demander à être entendu.

La convocation mentionne la composition de la formation. Elle indique à la personne poursuivie la faculté qui lui est offerte d’être entendue, en personne ou représentée par son conseil. Elle mentionne que ses observations écrites doivent parvenir à la formation restreinte et au rapporteur général au plus tard huit jours francs avant la séance.

Lorsque l’affaire est renvoyée à une audience ultérieure, le délai minimal de convocation peut être ramené à sept jours.
