I.-A request for the recusal of a member of the restricted panel must be made by the Principal Rapporteur, by the accused person or by his counsel within eight clear days of receipt of the summons referred to in Article R. 824-16. It must state the reasons for the challenge and, where appropriate, be accompanied by supporting documents, failing which it will be inadmissible.
II.-The chairman of the restricted formation and the member who is the subject of the challenge must be notified immediately of the challenge request.
The member concerned must state whether he agrees with the request or the reasons why he opposes it. In the event of opposition, the select committee shall decide on the request without the member concerned being present. The person making the request is informed immediately and by any means of the date of this meeting, of the possibility of presenting oral observations and of being assisted or represented.
III.-The decision of the restricted formation on the request for recusation is notified immediately to the person making the request, to the other persons concerned and to the general rapporteur. It may be appealed only together with the decision on the objections.
The challenge does not call into question the deliberations adopted by the restricted formation in the presence of the challenged member prior to the request for challenge.
