The general rapporteur or the investigator in charge of the case shall present the final report provided for in Article L. 824-8. The person being prosecuted and, where applicable, his or her counsel, present the defence. In all cases, the accused and his counsel must be allowed to speak last. If the accused, duly summoned, does not appear, the restricted formation may take a decision in his absence. However, if it deems it necessary for him to appear in person, it may refer the case to a later hearing. The restricted panel deliberates in the sole presence of its members and the session secretary. The decision is taken by a majority of the members. In the event of a tied vote, the chairman has the casting vote. The meeting secretary draws up a record of the meeting. The minutes are signed by the chairman of the select committee and the meeting secretary. It is sent to the persons who took part in the deliberation.
