Article R824-3 of the French Commercial code

When carrying out investigative acts on business premises, the investigator shall inform the statutory auditor or the manager of the legal entity concerned of the purpose of the audits he intends to undertake at the latest at the time of undertaking the audits.

The investigator may only enter the premises of the audited person during normal operating hours and in the presence of the manager or his representative.

He shall present the engagement order to any person with whom he carries out an investigative act.

Lorsqu’il effectue des actes d’enquête au sein de locaux professionnels, l’enquêteur informe le commissaire aux comptes ou le dirigeant de la personne morale concernée de l’objet des vérifications qu’il compte entreprendre au plus tard au moment d’entreprendre les vérifications.

L’enquêteur ne peut pénétrer dans les locaux de la personne contrôlée que pendant les heures normales de fonctionnement et en présence du responsable ou de son représentant.

Il présente l’ordre de mission à toute personne auprès de qui il effectue un acte d’enquête.
