Article R8252-9 of the French Labour Code

If, in the situation of the foreign employee referred to in Article R. 8252-8, the Director General of the Office français de l’immigration et de l’intégration decides to implement the financial solidarity of the principal referred to in Article L. 8254-2, he shall inform the principal, by registered letter with acknowledgement of receipt or by any other means allowing proof of its receipt by the addressee, that he must pay the sums due into an account opened by the Office in the name of the foreign employee concerned.

If the principal fails to pay by the end of the period set in the decision referred to in the previous paragraph, which may not be less than fifteen days following its notification, payment will be made under the same conditions as those set out in Article R. 8252-8.

Si, dans la situation du salarié étranger mentionnée à l’article R. 8252-8, le directeur général de l’Office français de l’immigration et de l’intégration décide de mettre en œuvre la solidarité financière du donneur d’ordre mentionné à l’article L. 8254-2, il informe le donneur d’ordre, par lettre recommandée avec avis de réception ou par tout autre moyen permettant de faire la preuve de sa réception par le destinataire, qu’il doit verser les sommes dues sur un compte ouvert par l’office au nom du salarié étranger concerné.

A défaut de règlement par le donneur d’ordre au terme du délai fixé dans la décision mentionnée à l’alinéa précédent, qui ne peut être inférieur à quinze jours suivant sa notification, il est procédé dans les mêmes conditions qu’à l’article R. 8252-8.
