Article R8272-10 of the French Labour Code

To determine the duration of the exclusion from administrative contracts of the person who has committed the offence in accordance with article L. 8272-4, the Prefect shall take into account the nature, number and duration of the offence(s) found, the number of employees concerned and the economic, social and financial situation of this person.

Le préfet tient compte, pour déterminer la durée de l’exclusion des contrats administratifs de la personne ayant commis l’infraction conformément à l’article L. 8272-4, de la nature, du nombre, de la durée de la ou des infractions relevées, du nombre de salariés concernés ainsi que de la situation économique, sociale et financière de cette personne.
