Article R917-18 of the French Commercial code

Article R. 713-9 reads as follows:

“Art. R. 713-9.-Applications are declared in writing to the prefecture.

“Declarations of candidacy are admissible from the day set by the order convening the electorate provided for in article R. 713-6 and until the fortieth day preceding the last day of voting at 12 noon.

“The declaration of candidacy shall state the surname, first names, gender, date and place of birth of the candidate from the college representing trade, industry and services, his/her nationality, the company name and address of the company in which he/she carries out his/her duties, the college in which he/she is standing and his/her registration number on the electoral roll.

“Each candidate shall certify to the Prefect, in the form of a declaration on his honour, that he fulfils the conditions of eligibility listed in article L. 713-4 and that he is not subject to any of the disqualifications provided for in article L. 713-3.

“Each candidate from the college representing activities in the agricultural sector must certify to the Prefect, in the form of a declaration on their honour, that they meet the conditions laid down in C of I of article R. 917-17.

“Each candidate from the college representing activities in the trades and crafts sector certifies to the prefect, in the form of a declaration on their honour, that they meet the conditions provided for in B of I of Article R. 917-17. “

Article R917-18

L’article R. 713-9 est ainsi rédigé :

” Art. R. 713-9.-Les candidatures sont déclarées par écrit à la préfecture.

” Les déclarations de candidature sont recevables à compter du jour fixé par l’arrêté de convocation des électeurs prévu à l’article R. 713-6 et jusqu’au quarantième jour précédant le dernier jour du scrutin à 12 heures.

” La déclaration de candidature indique le nom, les prénoms, le sexe, la date et le lieu de naissance du candidat relevant du collège représentant les activités du commerce, de l’industrie et des services, sa nationalité, la dénomination sociale et l’adresse de l’entreprise dans laquelle il exerce ses fonctions, le collège dans lequel il se présente et son numéro d’inscription sur la liste électorale.

” Chaque candidat atteste auprès du préfet, sous forme d’une déclaration sur l’honneur, qu’il remplit les conditions d’éligibilité énumérées à l’article L. 713-4 et qu’il n’est frappé d’aucune des incapacités prévues à l’article L. 713-3.

” Chaque candidat relevant du collège représentant les activités du secteur de l’agriculture atteste auprès du préfet, sous forme d’une déclaration sur l’honneur, qu’il remplit les conditions prévues au C du I de l’article R. 917-17.

” Chaque candidat relevant du collège représentant les activités du secteur des métiers et de l’artisanat atteste auprès du préfet, sous forme de déclaration sur l’honneur, qu’il remplit les conditions prévues au B du I de l’article R. 917-17. “
