Paragraph 2: Ship captains, aircraft commanders.

1. Masters of ships, boats and aircraft are deemed to be responsible for omissions and inaccuracies in the manifests and, in general, for offences committed on board their vessel. 2. However, the penalties of imprisonment enacted by this Code are applicable to the captains of merchant ships, warships or military or commercial aircraft only in the event of personal fault.

The master is relieved of all liability : a) in the case of an offence referred to in article 424,2°, below, if he proves that he has fulfilled all his supervisory duties or if the offender is discovered ; b) in the case of an offence referred to in article 424,3°, below, if he can prove that serious damage required the ship to be diverted and on condition that these…
