Title II: Criminal provisions and accompanying measures

In land transport companies, the aggravated penalties provided for in the third paragraph of article L. 3421-1 apply to staff performing driving or piloting duties as well as those assigned to the maintenance of vehicle safety devices. In air transport companies, the aggravated penalties provided for in the third paragraph of Article L. 3421-1 shall apply to staff performing the duties of : -command and control of aircraft ; service on board the engines, machines and various instruments necessary for the navigation of the aircraft; – maintenance of these engines, machines and instruments; -maintenance of these engines, machines and instruments.

In maritime transport companies, the aggravated penalties provided for in the third paragraph of Article L. 3421-1 apply to staff carrying out duties relating to the operation or piloting of ships, maintenance or navigation safety. This provision concerns : -personnel working as seafarers on board ships; personnel employed on board and designated to carry out fire-fighting or ship evacuation duties; -personnel responsible for security on board ships.
