CHAPTER II: Direct management of public services

The régies created pursuant to article L. 1412-1 are subject to the provisions of the chapitre 1er du titre II du livre II de la deuxième partie.

Local authorities, their public establishments, public establishments for inter-communal cooperation or mixed syndicates may individualise the management of an administrative public service falling within their remit by setting up a régie subject to the provisions of chapitre Ier du titre II du livre II de la deuxième partie. Excluded, however, are services which, by their nature or by law, can only be provided by the local authority itself.

For the application of the provisions of the chapitre Ier du titre II du livre II de la deuxième partie, les présidents de conseil départemental, de conseil régional, du conseil exécutif de Corse, de leurs établissements publics, des établissements publics de coopération intercommunale ou des syndicats mixtes exercent les fonctions qui sont dévolues au maire. The public cultural cooperation establishments created pursuant to article L. 1412-3 are subject to the provisions of the chapitre unique du titre III du livre IV de la première partie, with the exception of the provisions providing for the presence of the State on the Board of Directors and the appointment by the latter of qualified individuals as provided for in 2° of Article R. 1431-4.
