Section 1a: Complaints by electronic means

Online services enabling victims, in accordance with the provisions of article 15-3-1, to lodge complaints by electronic means, hereinafter referred to as “online complaints”, with the criminal investigation departments or units of the national police and gendarmerie, in respect of offences the list of which is set by order of the Minister of Justice, shall be implemented in accordance with the procedures set out in the provisions of this section….

If the online complaint relates to an offence that has caused material injury, the victim is informed that he or she may determine the amount of his or her injury and send supporting documents electronically. If justified by the nature of the offences that are the subject of the online complaint, and in particular in the case of complaints concerning sexual offences, the online complaint service must also include information on the possibilities for the victim to receive psychological and medical care.

If justified by the nature of the offence for which an online complaint is made, the victim is informed that any false statement may expose him or her to criminal prosecution, in accordance with the provisions of article 434-26 of the Criminal Code.

The online complaints service provides the victim, in a printable format, with a receipt for the complaint as well as a copy of the report of receipt of the complaint, which is signed, in accordance with the procedures set out in article 801-1, solely by the officer or agent of the judicial police who received the complaint, without being signed by the complainant. The provisions of articles D. 8-2-2 to D. 8-2-6 and D. 8-2-8 are applicable to online services made available to victims to lodge a complaint electronically with the public prosecutor pursuant to Article 40. These services provide the victim with a printable receipt of the complaint.

The court with jurisdiction over the offences referred to in article 15-3-1 is the Paris judicial court.
