Section 4: Sale of seized movable property

The sale of movable property placed in the hands of justice and, where applicable, the restitution of the proceeds of such sale, as provided for in the second paragraph of Article 41-5, shall be carried out in accordance with the procedures determined by the following articles.

Moveable assets placed in the hands of the law are handed over, with the authorisation of the public prosecutor, to the Agency for the Management and Recovery of Seized and Confiscated Assets, which proceeds with their disposal. The proceeds of the sale are deposited with the Caisse des dépôts et consignations. An entry is made in a special register kept by the clerk of the judicial court.

The public prosecutor who directed the investigation or that of the court hearing the prosecution shall inform the owner of the movable property by any means of his right to restitution of the proceeds of the sale as soon as he closes the proceedings with no further action or a final decision is made to dismiss the case, acquit or convict without confiscation having been ordered.
