Subsection 1: Judicial administrators who are members of the Commission nationale d'inscription et de discipline (National Registration and Disciplinary Commission)

The election of judicial administrators and their substitutes, members of the national commission, is organised by the Conseil national des administrateurs judiciaires et des mandataires judiciaires. It shall take place by a one-round majority multi-mandate ballot. Judicial administrators who, since the date on which the list was drawn up, have been the subject of a provisional suspension, temporary ban, striking off or withdrawal from the list may not take part…

Any receiver may refer the elections to the Paris Court of Appeal within five days of the proclamation of the results. The appeal shall be sent by registered letter with acknowledgement of receipt to the chief clerk of the court of appeal, who shall notify the government commissioner. The appeal may also be lodged by the government commissioner.

In the event of a vacancy in the seat of a titular member and his substitute, they shall be replaced by the first candidate and his substitute not elected. If there are no further unelected candidates, an election shall be held by majority vote in a single round in accordance with the procedures set out in article R. 811-3.

The other procedures for the election of judicial administrators to the national commission and in particular those for postal voting shall be determined by the bureau of the Conseil national des administrateurs judiciaires et des mandataires judiciaires in accordance with rules submitted for approval to the garde des sceaux, ministre de la justice.
