Section 4: Legal system for acts taken by municipal authorities and contentious actions

The provisions of Title III of Book I of this part relating to the legal regime for acts taken by communal authorities are applicable to the communes of the départements of Moselle, Bas-Rhin and Haut-Rhin with the exception of those of article L. 2131-10. The acts of the communes of the Moselle, Bas-Rhin and Haut-Rhin departments that were enforceable on 3 March 1982, the date of publication of the loi n° 82-213 du 2 mars 1982 relative aux droits et libertés des communes, des départements et des régions, en vertu de dispositions particulières applicables dans ces départements.

The municipal council deliberates on legal actions, subject to the provisions of article L. 2541-25.

The mayor, in an emergency, may, without the prior authorisation of the municipal council, bring and defend possessory actions and perform any legal act necessary to preserve the rights of the municipality or to avoid the consequences resulting from the expiry of time limits. He reports to the municipal council at its next meeting.
