Section 2: Determination by the overseas regions of the rules applicable in their territory in a limited number of matters falling within the scope of the law or regulations

Under the conditions and subject to the reservations provided for in this chapter, the regional councils of Guadeloupe and Mayotte may be empowered to lay down the rules applicable in the territory of their region in a limited number of matters that may fall within the scope of the law or regulation, with the exception of those listed in the fourth paragraph of article 73 of the Constitution.

The request for empowerment to lay down a rule applicable on the territory of the region shall be adopted by reasoned deliberation of the Regional Council taken by an absolute majority of its members. This deliberation shall mention the matter likely to be the subject of the empowerment provided for in Article LO 4435-9.
