Subsection 7: Information to the judicial authorities by the Banque de France.

The Banque de France may inform the Public Prosecutor and, at his request, provide him with information relating to cheque issues that have been reported to it as constituting a breach of a prohibition resulting from the application of Articles L. 131-73 or L. 163-6.

When the Banque de France receives notification from the Public Prosecutor’s Office of a prohibition ordered pursuant to Article L. 163-6 concerning a person who is already subject to the same measure in the process of being enforced, it shall notify the Public Prosecutor’s Office that last referred the matter to it, returning the notification and providing all relevant information, unless the effective date of the second prohibition immediately follows…

The Banque de France will provide any magistrate or judicial police officer acting on the instructions of the public prosecutor or on a court order with a statement of payment incidents recorded in the name of an account holder.

Applications submitted under article R. 131-40 must specify : 1° Where it concerns a natural person, his surname, forenames, date and place of birth and, where applicable, the surname used ; 2° If it concerns a legal entity, its name or business name, its national company number if it has one, the address of its registered office and its legal form.
