Section 2: Exercise of the mandate.

Industrial tribunal members are appointed for four years. Their term of office is automatically terminated in the event of loss of French nationality for any reason whatsoever. When the term of office of outgoing labour tribunal members expires before the period set for the installation of their successors, they remain in office until their successors are installed.

Employers shall allow employees of their company who are members of a labour tribunal the time necessary to travel to and take part in the labour tribunal activities determined by decree of the Conseil d’Etat.

Time spent away from the company during working hours by employee members of the labour tribunal in the performance of their duties is treated as actual working time for the purposes of determining the rights that employees derive from their employment contract, legal provisions and collective bargaining agreements. An employee who is a member of a labour tribunal and who works continuous or discontinuous shift work is entitled to have his working hours adjusted so as to guarantee him a minimum rest period.

The duties of an industrial tribunal member are free of charge to the parties.

Articles 4 and 5 of the Civil Code and 434-7-1 of the Criminal Code apply to industrial tribunals and their individual members.

A decree sets out the compensation arrangements for employees who work away from their place of work or for several employers.
