Subsection 1: Composition.

A departmental commission for inter-communal cooperation is set up in each department. It is chaired by the State representative in the department. The latter is assisted by a general rapporteur and two assessors elected from among the mayors.

I. – The departmental commission for inter-communal cooperation is made up of : 1° 50% by mayors, deputy mayors or municipal councillors elected by proportional representation on the basis of the highest average by the mayors grouped within electoral colleges determined according to the demographic size of the communes; 2° 30% by representatives of public establishments for inter-communal cooperation with their own tax system having their headquarters in the department,…

The conditions of application of articles L. 5211-42 and L. 5211-43 are set by decree in the Council of State. This decree fixes in particular the total number of members of the departmental commission, determined taking into account the population, the number of municipalities and public establishments of inter-municipal cooperation with their own tax status in the department and their demographic importance, the demographic criteria used to constitute the colleges…

In departments whose territory includes mountain areas delimited in accordance with article 3 of law no. 85-30 of 9 January 1985 relating to the development and protection of mountain areas, the composition of the colleges of representatives of the municipalities and public establishments for inter-municipal cooperation on the departmental commission for inter-municipal cooperation is determined by proportional representation of the municipalities and public establishments for inter-municipal cooperation located, in whole…
