Subsection 2: Transport and infrastructure management

For the application of article L. 4424-22, the application for a title of occupation constituting a real right over the public domain of the ports of Ajaccio and Bastia is addressed to the President of the Executive Council or to the concessionaire.

The application file is compiled in accordance with the conditions set out in II of article R. 57-3 of the Code du domaine de l’Etat.

The prefect has two months to give his opinion; after this time the opinion is deemed to have been issued.

In the case provided for in the second paragraph of II of article R. 57-4 of the Code du domaine de l’Etat, the concessionaire may not confer a right in rem on the title to occupy the public port domain without having obtained the prior agreement of the President of the Corsican Executive Council, after consultation with the Prefect of the département.

The system of fees for occupying the public domain is set by the Corsican Assembly on a proposal from the President of the Executive Council.

Articles R. 57-5-1 to R. 57-9 of the Code du domaine de l’Etat are applicable to titles issued or granted pursuant to article L. 4424-22.
