Subsection 5: Conditions for referral to the Agency by academies, medical or scientific learned societies and approved associations

In application of Article L. 1418-1, the academies, learned medical or scientific societies and approved associations mentioned in Article L. 1114-1 may refer to the Agence de la biomédecine any request for advice or information on medical, scientific or ethical issues falling within the Agency’s areas of competence.

The head of the applicant body or association must send the application to the Director General of the Agency by letter or electronically. It must state the reasons on which it is based and be accompanied by all the documents required for its examination. Several approved bodies or associations may submit a joint application to the Agency.

The Director General of the Agence de la biomédecine will acknowledge receipt of the request and specify the time required to examine it. If the request requires resources that are excessive in relation to those that the Agency is able to provide in order to process it, or if it does not fall within the Agency’s area of competence, the Director General will inform its authors that it cannot be…

The Director General of the Agence de la biomédecine will forward the response sent to the authors of the referral to the Minister for Health and to the other Ministers concerned as soon as possible.
