The members of the restricted formation of the departmental commission for inter-municipal cooperation are elected at the installation meeting of this commission and after each general renewal of the municipal councils. The members of the restricted formation of the departmental commission for inter-communal cooperation are elected for the duration of their term of office on this commission. When a seat becomes vacant on the select committee, it is filled under the conditions set out in article R. 5211-31, within one month of the vacancy occurring.

The restricted formation of the departmental commission for inter-municipal cooperation is chaired by the prefect and the general rapporteur of the departmental commission for inter-municipal cooperation assumes the same functions within this formation. The secretariat of the select committee is provided by the prefecture.

When the public establishment for inter-municipal cooperation from which a commune applies to withdraw includes the commune of Paris, the restricted formation of the competent departmental commission for inter-municipal cooperation is completed by two representatives of the commune of Paris, appointed by the Paris council from among its members.
