TITLE I: GENERAL PROVISIONS

French Guiana is a territorial collectivity of the Republic governed by Article 73 of the Constitution, which exercises the powers attributed to an overseas department and an overseas region and all the powers devolved to it by law to take account of its particular characteristics and constraints.

The territorial collectivity of French Guyana succeeds the department of French Guyana and the region of French Guyana in all their rights and obligations.

The determination and transfer of the capital of the territorial collectivity of French Guyana is decided by decree in the Conseil d’Etat, after consultation with the Assembly of French Guyana and the municipal councils of the communes concerned.

For the application of this code in French Guiana: 1° The reference to the department, the overseas department, the region or the overseas region is replaced by the reference to the territorial collectivity of French Guiana; 2° The reference to the regional council or the general council is replaced by the reference to the assembly of French Guiana; 3° The reference to the president of the general council or the…
