Subsection 2: Retirement

The President of the Assembly of French Guyana or the Vice-Presidents delegated by the latter who, for the duration of their term of office, have ceased to exercise their professional activity and do not acquire any pension rights under a compulsory old-age insurance scheme shall be affiliated to the old-age insurance scheme of the general social security scheme.

Councillors to the Assembly of French Guiana other than those referred to in article L. 7125-28 may set up an annuity pension scheme in the management of which the affiliated elected representatives must participate. The annuity pension scheme is set up on the basis of half the elected representative and half the territorial collectivity of French Guyana. A decree in the Council of State sets the contribution rate ceiling.

Councillors to the Assembly of French Guyana shall be affiliated to the supplementary pension scheme instituted for the benefit of non-tenured public authority employees. Pensions paid pursuant to this article may be accumulated without limitation with any other pension or retirement.

For the application of articles L. 7125-28 to L. 7125-30, the contributions of the territorial collectivity of French Guyana and those of its elected representatives are calculated on the amount of compensation actually received by the latter pursuant to section 3 of this chapter or any other text governing the compensation of their functions. The contributions of elected representatives are personal and compulsory.
