Chapter I: The creditor and the writ of execution

The enforcement judge of the Paris judicial court has sole jurisdiction to rule on the application for authorisation provided for in Article L. 111-1-1 and on disputes relating to protective measures and forced execution on movable property that it authorises, as well as to hear seizure procedures on immovable property that it authorises, with the exception of forced execution procedures on immovable property located in the departments of Bas-Rhin, Haut-Rhin…

The application must be submitted in duplicate. It shall state the reasons on which it is based and shall include a precise indication of the documents relied upon.

The order on application shall state the reasons on which it is based. It is enforceable on the basis of the minutes alone.

The creditor shall proceed with enforcement under the conditions specific to each measure, as defined in this Code. Where the order relates to a protective measure, Articles R. 511-4 to R. 511-8 are also applicable.

The bailiff carries out the enforcement on presentation of the judge’s authorisation. If the foreign State is notified of the enforcement measure, a copy of the application and the order must be attached.
