TITLE IV: PROVISIONS APPLICABLE IN THE WALLIS AND FUTUNA ISLANDS

Subject to the adaptations provided for in this Title, the following provisions of the regulatory part of this Code are applicable to Wallis and Futuna: 1° Book I, with the exception of the second paragraph of Article R. 112-4, Articles R. 162-2, R. 162-3 and R. 162-7 ; Article R. 121-1 as amended by Decree no. 2020-1452 of 27 November 2020; Article R. 121-5 as amended by Decree no. 2019-1419…

In the absence of adaptation, references made by provisions of this Code applicable in Wallis and Futuna to provisions that are not applicable there are replaced by references to provisions with the same purpose that may be applicable locally.

For the application of this Code in Wallis and Futuna, the terms listed below are replaced as follows: 1° “Judicial Court” by “Court of First Instance”; 2° “Commercial Court” by “Court of First Instance dealing with commercial matters”; 3° “Public Prosecutor” by “Public Prosecutor at the Court of First Instance”; 4° “Family Court Judge” by “President of the Court of First Instance or his delegate”; 5° “Court of Appeal” by…

For the application of this code in Wallis and Futuna: 1° Summonses, summonses, service, notifications and delivery of documents may be made by ordinary letter against a receipt; 2° The amounts expressed in euros in this code are replaced by their equivalent in local currency.

For the application of article R. 121-7, the overseas collectivity of Wallis and Futuna may be represented or assisted before the judge by a civil servant or an agent of its administration.

For the application to Wallis and Futuna of article R. 124-2, the words: “or one of the institutions or establishments mentioned in article L. 518-1 of the same code” are deleted.

For its application in Wallis and Futuna, Article R. 212-1 is worded as follows: “Art. R. 212-1. – Attachment and assignment of remuneration are governed by the provisions of Decree no. 55-972 of 16 July 1955 relating to attachments, assignments and deductions from the wages or salaries of workers within the meaning ofArticle 1 of Act no. 52-1322 of 15 December 1952. “

For the application to Wallis and Futuna of article R. 213-10, the words: “the sum set inarticle R. 3252-5 of the Labour Code in application of article L. 3252-5 of the same code” are replaced by the words: “a sum set by order of the State representative”.

For the application of Article R. 412-2 in Wallis and Futuna, the word: “départemental” and the words: “la loi n° 90-449 du 31 mai 1990 visant à la mise en œuvre du droit au logement” are replaced respectively by the word: “territorial” and the words: “la réglementation le cas échéant applicable localement”.

For its application in Wallis and Futuna, Article R. 531-1 is worded as follows:
