Section 4: Approvals and changes to shareholdings

I. – In application ofArticle L. 612-21, the Autorité de contrôle prudentiel et de résolution draws up and updates, in the form of an electronic register, the lists of the following persons: 1° The persons mentioned in A of I ofArticle L. 612-2 and in 2°, 3° and 4° of Article L. 612-21 ; 2° Credit institutions, financial institutions and investment firms whose registered office is in another State party…

I. – The Autorité de contrôle prudentiel et de résolution shall notify the Autorité des marchés financiers of decisions relating to the authorisation or empowerment of the persons referred to in 2° of A of I ofArticle L. 612-2 and decisions relating to the authorisation of credit institutions providing investment services. II. – The Autorité de contrôle prudentiel et de résolution shall immediately notify the European Banking Authority of decisions…

After obtaining the opinion of the Consultative Commission referred to in I of Article L. 612-14, the AMF may draw up standard application files, including the list, format and procedures for transmitting the information it requires. They will be published in electronic form in the Authority’s official register.

When the Autorité de contrôle prudentiel et de résolution proposes to the European Central Bank that the authorisation of the credit institution in question be withdrawn, it shall first obtain the opinion of the collège de résolution if the credit institution is subject to one of the resolution measures provided for in Article L. 613-31-16.
