Section 4: Housing concessions granted to civil servants

In the buildings of the centres for which the region is responsible in application of articles L. 114-5 and L. 114-7 of this code, housing concessions are granted by the region to State employees under the conditions laid down in this section.

Housing concessions are granted on the basis of absolute necessity of service or by precarious occupancy agreement with standby duty, in accordance with the conditions laid down in the first paragraph of article R. 2124-65 and the first and second paragraphs of article R. 2124-68 of the General Code of the Ownership of Public Persons and by this section.

In accordance with the criteria set out inarticle R. 2124-65 of the General Code on the Ownership of Public Property, State employees in the following categories are provided with accommodation on an absolute service requirement basis, under the conditions defined in article R. 114-45: a) Directors, managers, technical and teaching staff, medical and paramedical staff; b) Technicians, workers and service staff who have chosen to remain State employees and who…

The number of staff members mentioned in a and b of article R. 114-44 and accommodated under absolute necessity of service is determined, according to the size and specific nature of the centres and the functions carried out by the staff members, in accordance with the provisions set by an order of the Minister responsible for sports after consultation with the President of the region concerned.

When all the needs resulting from service considerations have been met, the centre’s Board of Directors, on the basis of the Director’s report, makes proposals for the allocation of any accommodation that remains vacant. The region to which the centre is attached may grant government employees, by virtue of their duties, precarious occupancy agreements without penalty for such accommodation in return for a fee that it determines.

Only those housing concessions granted on the basis of absolute necessity of service include free bare accommodation. Charges relating to the supply of fluids and other ancillary services are either borne directly by the employee or reimbursed to the organisation that has advanced them. Precarious occupancy agreements with or without on-call duty do not include any free ancillary services.

Each year, the home region sets the discount rate for the value of the ancillary benefits mentioned in article R. 114-49 for each of the categories of staff mentioned in article R. 114-44.

In the case of a precarious occupation agreement with or without a penalty payment, the fees set out in articles R. 2124-68 and R. 2124-79 of the General Code on the Ownership of Public Property are determined, modified or revised by the region to which the centre belongs.

On the basis of a report from the Director of the Centre, the Board of Directors proposes to the Region the posts whose holders are granted accommodation on the basis of absolute necessity of service or under a precarious occupation agreement with or without standby duty, the location and size of the premises granted and the financial terms of each grant.
