Subsection 7: Deposit and seizure

The provisions of this subsection are applicable in the context of the investigation and establishment of offences.

Conditioned products, objects or equipment shall be left in the custody of their holder or, failing that, deposited in a room designated by the authorised agents. .

Seizures may be made following on-site findings or laboratory testing or analysis of a sample taken.

The authorized agents draw up a seizure report, which is sent to the public prosecutor within 24 hours.

The seized products, objects or appliances shall be left in the custody of their holder or, failing that, deposited in a room designated by the authorised officers.

The authorised agents may destroy, sterilise or denature the products mentioned in 1° of article L. 512-29.These operations are recorded and justified in the seizure report.

Where the regulations provide for a procedure involving the sampling of one unit of a model and then, in the event of non-compliance, additional units of the same model, these additional units may be consigned pending the results of the test carried out on the first unit.
