Any breach of the obligation to obtain the consumer’s express consent under the conditions set out in article L. 121-17 is punishable by an administrative fine of up to €3,000 for a natural person and up to €15,000 for a legal entity. This fine is imposed under the conditions set out in Chapter II of Title II of Book V.
