Chapter II: Prohibited and regulated commercial practices

Refusals to sell or provide services, in disregard of the provisions of the first paragraph of article L. 121-11, are punishable by the fine laid down for 5th class offences. Recidivism is punishable in accordance with the provisions of articles 132-11 and 132-15 of the Penal Code.

Subordination to conditions, of sales or provision of services, in disregard of the provisions of the second and third paragraphs of Article L. 121-11 are punishable by the fine provided for 5th class contraventions. Repeat offences are punishable in accordance with the provisions of articles 132-11 and 132-15 du code pénal.

The rules relating to the prohibition of forced mail order sales are defined by article R. 635-2 of the Criminal Code.
